Welcome to AndrewCarotenuto.com. By accessing or using my Site or purchasing services or artwork from me, you agree to be bound by the following Terms and Conditions. Please read them carefully.
1. Intellectual Property Rights
All content displayed on this Site—including but not limited to website layouts, portfolio designs, graphic assets, branding concepts, text, logos, and original watercolor, acrylic, or digital artwork—is my exclusive intellectual property and is protected by United States and international copyright laws.
2. Art Purchases
Purchasing an original piece of fine art or a print grants the buyer physical ownership of that piece, but does not transfer copyright or reproduction rights. You may not copy, scan, resell, or reproduce the artwork for commercial purposes without an explicit, signed licensing agreement from me.
3. Design Services
For freelance graphic, web, or packaging design services, intellectual property rights to the final custom designs are transferred to the client only upon final payment of all outstanding project invoices. I retain the right to display the finalized work within my professional portfolio and marketing materials unless a non-disclosure agreement (NDA) is signed prior to the project.
4. Commercial Services, Invoices, and Quotes Project Pricing: Formal quotes issued via my system are valid for 30 days from the date of issuance.
5. Deposits
All custom design projects require a non-refundable deposit (typically 50%) before project strategy and design work begins.
6. Final Payment
Final files, high-resolution production assets, and ownership transfers of custom Wix websites will be withheld until the final project invoice is paid in full.
7. Art Shop Purchases and Returns Fulfillment
I make every effort to package and ship original art safely. Shipping timelines are estimates and are subject to carrier delays.
8. Returns
Due to the custom and delicate nature of original fine art and made-to-order prints, all sales on original artwork are final. If an item arrives damaged during transit, please contact me within 48 hours of delivery with photographic proof so I can assist you with an insurance claim and resolution.
9. Limitation of Liability
In no event shall Andrew Carotenuto be liable for any indirect, incidental, special, or consequential damages resulting from the use of my website, the delay or inability to use my site, or the performance of any services or products purchased through the site.
10. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.
